MAJOR LEAGUE INSTRUCTORS PARTICIPANT WAIVER, RELEASE, AND INDEMNITY AGREEMENT
1. Acknowledgment of Risks and Assumption of Risk
I, the undersigned Participant (or Parent/Guardian if the Participant is under 18), hereby acknowledge that my participation in the Major League Instructors programs—including but not limited to in-person training sessions, virtual baseball instruction, clinics, camps, and related activities—involves inherent risks. These risks include, but are not limited to, the possibility of serious injury, permanent disability, paralysis, or death. I understand that such risks may arise from my own actions or inactions, the actions or inactions of others, or the condition of the facilities, equipment, or instruction provided.
2. Release and Waiver of Liability
In consideration for being permitted to participate in any and all activities provided by Major League Instructors, I voluntarily and knowingly agree to release, waive, discharge, and covenant not to sue Major League Instructors, its owners, operators, coaches, instructors, employees, agents, and representatives (collectively, “Released Parties”) from any and all liability, claims, demands, or causes of action whatsoever arising out of or related to any loss, damage, injury, or harm (including death) that I may suffer, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to my participation in the activities provided by Major League Instructors, including any claims brought by third parties.
4. Certification of Physical Fitness
I certify that I am physically fit and capable of participating in the activities offered by Major League Instructors. I have consulted or had the opportunity to consult with a physician regarding my ability to participate and have not been advised against doing so.
5. Virtual Instruction Disclaimer
I acknowledge that virtual baseball instruction, while designed to enhance my skills and understanding of the game, does not guarantee specific results and may not fully replicate the benefits or safety measures of in-person training. I assume all risks associated with the use of digital platforms, including any technical issues, interruptions, or limitations inherent to virtual instruction.
6. Medical Treatment Authorization
In the event of an emergency, I consent to receive medical treatment deemed necessary by instructors or emergency medical personnel. I agree to be responsible for any related costs and certify that all information provided regarding my health and physical condition is accurate and complete.
7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the state in which Major League Instructors operates, without regard to its conflict of laws principles. I hereby consent to the exclusive jurisdiction and venue of the appropriate state and federal courts for the resolution of any disputes arising under this Agreement.
8. Severability
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable in any respect, the remaining provisions shall continue in full force and effect.
9. Acknowledgment and Agreement by Registration
By registering for a lesson with Major League Instructors, I acknowledge that I have read this Participant Waiver, Release, and Indemnity Agreement in its entirety and fully understand its terms. I understand that my registration constitutes my voluntary and unconditional acceptance of this Agreement, and that I am thereby waiving substantial legal rights—including the right to sue the Released Parties for any injuries or damages that may result from my participation.
